Can I do a Deed in Lieu of Foreclosure on a rental property if I already have a judgement against me on a different property?

Well you can always do a deed in lieu but that does not guarentee you are release from the full obligation. IF you do a deed in lieu it should be accompanied by a letter of "Accord And Satisfaction" that states the fiing of the deed by the mortgage lender constitutes that the account is settled in full. Any real estate lawyer should be able to draft it for you in under two hours. MAke sure you send the deed and accord & satisfaction letter registered mail, to cease any ptetial collection activity. You should negociate with your lender the terms of settlement verses just sending a deed and letter.

Well you are probably NOT going to like my answer but her goes... "Who Cares" Why worry about being able to join an institution that fails 50% of the time? Civil unions are by far superior, they layout the exact ground work should you and your partner deside to part ways one day, like a prenuptual, its a contactual partnership. This way you prevent some judge from desiding who gets what, you get to demand a jury trial. Also should trouble arise you can refer to the agreement, not some ambiguous "marriage license".

What can one due if a public defender appears to be railroading you. If you provide him with 100% eviedence and he does not use it causing you to loose you case what can be done?

All to often public pretenders have an agenda. If you are in Florida there is a process called a Nelson hearing. Each state has a process for you to remove an ineffective lawyer from representing you. You must demand a hearing of ineffective assistance, this is typically specific problems, not general dissatisfaction with your lawyer. Google "Nelson hearing" for information. I imagine you are with a public pretender due to your finances, you should scrape together a few hundred bucks to consult with a real criminal defense lawyer preferably certified in criminal law. Don't go to a general practitioner.
