and with interest it comes out to 362,000. He found out after he started that he had hearing problems and would not be able to finish so he quit the program but he still owed all of the money. The private loan was from a bank in Ohio and the school was in Florida. The school also closed down after he quit. The bank also paid the money to the school instead of him which he said they are not supposed to do. He is also a veteran. He can’t even use his GI bill because he is in default with this loan. I read that student loans can be part of bankruptcy if it would cause the debtor “undue hardships” and this seems like it’s that way. He has been told by a lawyer that he cannot file bankruptcy because a) it is a private loan instead of a federal loan b) because Ohio law won’t let you put student loans in bankruptcy, c) that because it involves 2 different states he can’t file. So is what the lawyer saying true?

In a nut shell, my husbands ex-wife did not respond to a modification of supplemental petition. She was served by a process server and did not respond. She has been mailed the final hearing information and has expressed that she will not attend. The modification gives us primary custody however there is an lagging question of child support arrears. My husband lost his job in October 2008. Since then he has been unable to pay her child support. Since August 2008, we have had unofficial primary custody with greater than 75% of the time spent with us. We can verify this claim with school records and pictures. My question is two fold. First, with her default on the modification and unwillingness to attend the hearing, will that weigh on the decision of the court to grant our motion? Second, with close to k owed in back child support and documentation to prove we still maintain unofficial primary custody (in fact, there has been no visitation this month) what steps can we take prior to the hearing to argue a dismissal of the back owed support? We current reside in Florida. Thanks!
Many Many Thanks and especially to Dear Jane for her extensive insight. My husband has been looking for work since loosing his job. He was turned down by McDonalds, Walmart, Kmart and even Burger King. Downsizing in the government and his education in a specified field has made it extremely difficult to find employment. Either over qualified and afraid he’ll leave at the first chance for better work or under qualified because he needs a bachelors degree.
Regarding his ex-wife. She is financially unable to hire a lawyer. She was just evicted from her apartment and her current boyfriend has a couple felony convictions which landed them in a pay-by-the-week trailer park. I am 99% sure she will not show for the hearing and has expressed that she will not attend.
I know the back support is going to be a fight. Our Judge is male and we have retained counsel however at 0 an hour, it’s cheaper to ask on here

Why is it a response of lawyers, when they hear about abusive, corrupt acts of government officials, to advise those harmed by the corrupt government officials to hire a lawyer?
Some things should be dealt with as a crime, not as a lawsuit. Or don’t lawyers care, especially if it generates fees they can collect from those harmed by the corruption.?
And do they really think that such lawsuits would accomplish much in a locality where corruption is widespread, even accepted as part of the culture? How many of the local judges could be trusted in such a situation?

A friend of mine entered into an arranged marriage many years ago that her mother instigated for financial gain. Now she wants to get divorced. She is a Chinese citizen living abroad who wants to get the divorce accomplished without returning to China. .
She phoned a lawyer in her hometown who asked for 8000 RMB to complete the process. This seems expensive to her. Does anyone have any knowledge in this area?

The case involves a lawsuit over a noncompete clause in a contract. The case has already gone to a judge, but there is no ruling yet. Should I tell the opposing lawyer? The lawyer of the lady who lied? I have written proof and witnesses who should be able to corroborate my evidence. This lady is a habitual liar and also my wife’s business partner. How should I proceed?

I was arrested in a very small town for alledged public intoxication. Despite my requests, no bloodwork, breathalizer or field sobriety tests were conducted. The charge has been dismissed. Still, my name was listed in local newspapers. I am not interested in making money off of this. I would like for others in this tiny town to be made aware of their civil rights and I would like to be reimbursed for court and legal costs. Is there anything I can do besides hiring a lawyer to file a lawsuit?

My husband of 14 years wants a divorce. We have gone to counseling, and he is unwilling to try to save the marriage. Even though I am hurt, I cannot force him to love me. We have two young children. I currently work part-time and go to college full-time. We agree on how much support I would need, and what kind of visitation and property split would occur. Should we try a mediator and forgo lawyers?

I am in the middle of a medical malpractice lawsuit, my lawyer said they go to mediation june 1st…what is the process after that? if we settle, how long does it take after that to actually get the money in hand? They wont tell me anything…im confused…any advice would be helpful, thanks!

I am looking to purchase a auction house. I completed my own title search and found a IRS lien for over 200,000.00. I have earnest money tied up into an joint escrow account with the auction company. If I pull out now can I get any of my earnest money back? My lender have not completed their title search yet, nor have they completed the appraisal.
