My house has recently been placed on the market. I have never been late on a payment for my mortgage and I could refinance but, I am also going through a divorce. I would rather sell the house and try to get out from underneath it. I just received a notice from the Town that a Tax Lien is going to be placed on my property on May 1st. How is this going to affect me and the sale of my home?

Does the mortgage lien stay with the property or the original owner?
How much does it typically cost to foreclose if the tax lien is not paid back with interest? Does the mortgage company or bank have the opportunity to pay for the tax lien?

I purchased a Florida tax lien certificate in 2005…The redemption period ended after 2 years & it hasn’t been redeemed.I found out I have up to 7 years to foreclose but need to go to County Clerk pay 0 & file for foreclosure…and then it goes into a Tax deed sale. Before I do that… my question is, what is the chance of getting the property? Property has 2 mortgages…Do the banks come & outbid & win property at auction? Is there a secondary market whereby I can sell this tax lien certificate wihtout going to tax deed auction.If I was to foreclose & win at Tax deed auction will I be responsible for other debts from previous owner? What is best course of action? Thx

More specifically, my wife doesnt want house which there is little equity anyway. We are going to do FHA streamline to take her off then take her off title afterwards. Again, she absolutely wants nothing to do with home. As far as lender is concerned we are still technically married and have not filed anything. Can we be sued or go to jail if we divorce a few months after refinancing? I have not lied to the bank because we ARE married, we just told them she wants off the mortgage, which is also technically true.

To clarify, we do not have a mortgage now. We have a FTL on our credit report and would like to get a mortgage. We are renting.

The thing is, it’s with our water bill which the city/postal sevice is not good about getting our bill to us and we have money in escorw which would cover it. Im just mad because I got a letter stating if we don’t pay they will put a lein on the house, last year they just added it to the taxes and the mortage company paid it. I think they should do that again. Any thoughts?

If the owner of the property does not repay the taxes in the specified time frame, and you have to foreclose, I assume you must also pay the mortgage. Is this correct?
