Florida Divorce Question?

My stepdaughter and son-in-law were married about 5 years ago while he was in the country illegally. After some time and after the birth of their son, they agreed that it would be best if he obtained legal status, so he was required to return to his country (Mexico) and wait while the immigration process ran its course. During that 20 month period their relationship was strong and she visited him in Mexico with the child several times. Only a few months before he was to return (October 2009) she met another man and cheated on her husband, and she has maintained this relationship to date. When he returned with as a legal US resident she kicked him out of the house. He had no money or job at the time. My wife and I took him in of course and he has been living with us since then. He has been working sporadically. I’ll skip all the mean and lousy things she has said and done to him, but it should be noted she was recently diagnosed with Bipolar Disorder. She is only reasonable once in a while. She is a Registered Nurse and makes decent money (perhaps 60k/yr). She does have 2 other children (11) from previous married (she receives child support from their father) and owns a home, but is upside down in that home.

A few days ago she filed for divorce/dissolution, sent him copies of the paperwork and asked him to go to her attorney’s office to sign. Most of the terms are standard and reasonable, including shared visitation of their child and a division of assets, but some modifications are needed. Also, she would keep the house, and she is requesting 0 a month child support. While my son in law is completely willing to support their child and would be happy to pay even more if he could, he simply does not have that kind of money. He is living with us, works as much as he can which varies a lot, and as a house painter is not making much money. He is in no position to pay very much in child support until he can save some money, get out on his own, and obtain steady work. We know we can use the Florida Child Support worksheets to have the amount modified, at least for now. The big questions we have are:

-Now that she has served him with the papers, what exactly must he do to have changes made? Keep in mind, neither he nor we can afford an attorney, at least not more than a few hundred dollars, perhaps for legal assistance.

-Can he deny her filing and file a petition on his own? If so, can he sue her for Infidelity and obtain any compensation from her (again, he may not do that, but we want to know what the law is)

-Is there a time frame for him to respond, and if so, what is considered a “response”? Can he refuse to sign the divorce papers and not have it go into effect by default?

What other advice can you provide?

    Have you ever been afraid to date because the person you are dating seems very prone to divorce or prone to cheat? I am not dating now, and I think I like it. However, sometimes certain Ladies have caught my eye, and I wanted to date them. However, I keep noticing their behavior. They seem to have patterns that could lead to destruction in a relationship.

      Can divorce lawyer and his client start to date and start a relationship after one year of her divorce being filed with court and judge? He is also divorce and available but has kids. They have mutual respect and admiration for each other; they live in the same estate and go to the same church. But in a few months she will still needs his help for setting up a trust and will for her kids. Is this situation considers she is still a client and he is still her lawyer. They cannot romantically involved?

      My ex husband and I are working on a new and improved relationship together, attempting to reconcile. I am having a hard time with the divorce even though we are still working on things. There is a divorce support group at my church and I am considering going, but I don’t really fit the criteria.       My husband had an affair and I am considering divorce if we cannot work things out and improve our relationship. However, we have 3 kids and I would like to hear from other moms who have had to care for 3 children alone. Is it manageable. They are all 9 and under.

      Here’s a hypothetical situation: California voters (or the voters in your state of residence) pass an amendment to the state constitution which says that marriage is defined solely as a union between one man and one woman, and the man must be taller than the woman. Would you:

      1. Accept this law, since “the people have spoken,” and the will of the majority must always prevail.

      2. Accept this law, since in your relationship, as in most traditional marriages, the man is taller than the woman.

      3. Fight to have this law repealed, since it is clearly discriminatory and intrusive, and gives the government the power to control what is a personal, social, and/or moral issue.

      If your answer is Number 3, can you provide an argument for why you would do so that is logically consistent with your reasons for supporting Proposition 8?

      Also, please note the part about it being a “hypothetical situation,” as in, made up for the purposes of a thought experiment. Reasons why this would never happen are not valid answers (nor are attacks on my character or predictions of where I’m going to spend eternity). I don’t see how there is a logical difference, but there are a lot of people out there who are smarter than I am, so if there is a difference I’d like someone to point it out and explain it to me in terms even I can understand :)

      Also note that this is not a "trick" question. There is no "Ha! But guess what!" waiting for you. I think I’ve been sufficiently transparent in my wording that it’s painfully obvious what I’m getting at. I’m not trying to open up a forum for both sides to bash each other (so Prop 8 opponents, please try to restrain your indignation and be civil), but I would like to explore the ramifications of this amendment.

      I need to know about how to go about a divorce with 3 minor children involved. The father says he will dispute if their is anything about custody or support. He don’t take care of the kids anyways. I have been involved in a relationship with a guy who takes care of the children, and the father only calls to talk to me not to the children. What should I do? And how would I go about filing for the divorce and soul custody. Meant to tell you we have been seperated for over a year now.
